Man Accused Of Planet Fitness Beating On Trial

During a motion hearing Tuesday in Saline County Court, Judge Walden Morris granted Burns defense attorney Duane Verity’s motion to have Burns tested for mental fitness — he said in his motion that he does not believe Burns has the capacity to aid in his defense, stating that he cannot follow a single line of thought for very long and conflates his murder trial, a civil trial against him and a previous attempted kidnapping trial. The ruling vacates his Jan. 23 jury setting, pushing back the start of the trial.
